Which of your Data will be processed by us? And for what Purposes?
If we receive data from you, we will basically only process it for the purposes for which we have received or collected it. Data processing for other purposes can only come into consideration if the legal provisions required in this respect are available pursuant to Art. 6(4) of the GDPR. In this case, any information obligations that may arise pursuant to Art. 13(3) and Art. 14(4) of the GDPR will of course be observed.
On what legal Basis is Data Processing based?
Legal basis for the processing of personal data is principally Art. 6 of the GDPR – insofar as specific legal provisions do not exist. The following possibilities are particularly worth considering:
- Data processing on the basis of your consent (Art. 6(1a) of the GDPR)
- Data processing for the performance of a contract (Art. 6(1b) of the GDPR)
- Data processing on the basis of a balance of interests (Art. 6(1f) of the GDPR)
- Data processing for compliance with a legal obligation (Art. 6(1c) of the GDPR)
If we process data on the basis of a balance of interest, you as the data subject have the right to object to the processing of personal data considering the provisions of Art. 21 of the GDPR.
For how long is the Data stored?
We process the data as long as it is necessary for the respective purpose. Insofar as statutory duties to preserve records exist - e.g. under commercial or tax law - the personal data concerned will be stored for the duration of these duties. After expiration of the duty to preserve records, there will be a review to determine whether a further requirement for processing is present. If a requirement no longer exists, the data will be deleted. As a matter of principle, we regularly review data with regard to the requirement of further processing. Due to the amount of data, this review is made in respect of specific types of data or processing purposes. Should the review reveal that there is no requirement for further processing, the data will be deleted.
To whom is the data passed?
As a matter of principle, transfer of your personal data to third parties only takes place if this is necessary for the performance of a contract with you, if the transfer is admissible on the basis of a balance of interests within the meaning of Art. 6(1f) of the GDPR, if we are legally obliged to the transfer or if you have given your consent.
Where is the data processed?
We will process your personal data exclusively in data centers of the Federal Republic of Germany or a member state of the European Union.
Your Rights as Data Subject
You have the right to information about your personal data processed by us at any time. If it is not required, you can request that the data be deleted or that processing be restricted. In the case of a request for information not made in writing, we ask for your understanding that we may then require proof that you are the person you claim to be. Furthermore, you have a right to correction, deletion or restriction of the processing, insofar as you are legally entitled to do so. In addition to it, you have a right to object to the processing within the limits of statutory provisions. The same applies to a right of data transferability. In particular, you have a right to object in line with Art. 21(1 and 2) of the GDPR to the processing of your data in the context of direct advertising if this is based on a balance of interests.
